Which employers are cap-exempt?
Higher education institutions, nonprofit entities related to or affiliated with them, and nonprofit or governmental research organizations. A petition filed by one of these employers is not subject to the annual H-1B quota and can be filed at any time of year. We confirm the employer qualifies before filing.

Who qualifies for the returning client rate?
This package is for clients we have represented before, at an attorney fee of $2,799. If you are not sure whether your prior case qualifies, ask us and we will confirm before you sign.

Do I need to be selected in the lottery?
No. A cap-exempt petition bypasses the March registration and the annual quota entirely. This is why it is often the practical option for researchers and university staff who were not selected in the lottery.

What does the attorney fee cover?
Background evaluation and a tailored case plan, LCA account registration and filing, a customized petition letter, professional completion of the USCIS forms, and free EIN certification for the petitioning employer. USCIS filing fees and courier costs are billed separately.

If I later move to a for-profit employer, does my H-1B transfer?
Not automatically. Time spent in cap-exempt H-1B status does not count you against the cap, so a move to a cap-subject employer normally requires going through the lottery unless you were counted against the cap previously. Talk to us before accepting such an offer so the timing can be planned.

What happens if USCIS issues a Request for Evidence?
An RFE response is not included in this package. We quote it based on the issues raised and begin work once you approve the quote.

How long does adjudication take?
Processing times depend on USCIS workload, and premium processing is available for cap-exempt petitions. We confirm the current processing time and the premium processing fee before filing.
