Eligibility assessment and strategy (retainer $2,500 on signing)

We review your education, research or professional record, citations and industry impact, confirm that you meet the EB-2 National Interest Waiver standard under Matter of Dhanasar, and set the case strategy.

Evidence preparation and collection

You supply documentation of your achievements; we organize it, identify the gaps and tell you what is still missing. Under the Basic package you identify your recommenders and provide their letters; drafting by the firm is $500 per letter.

Drafting and filing ($2,000 before filing)

We draft the petition letter, your personal statement and the exhibit index, assemble the full record and file Form I-140 with USCIS.

Case tracking and approval ($2,000 after approval)

We monitor the case, report every USCIS notice promptly, and the final installment falls due once the I-140 petition is approved.

How is the attorney fee paid?

In three installments: $2,500 on signing the engagement agreement, $2,000 before the I-140 petition is filed, and $2,000 after the petition is approved, for a total of $6,500.
Are USCIS fees included?

No. The USCIS filing fees for Form I-140 and Form I-485, the optional premium processing fee, and the $80 courier cost are billed separately. USCIS adjusts its fees periodically, so we confirm the current amounts in writing before filing.
How are recommendation letters handled in the Basic package?

You identify your recommenders and provide their letters. If you would like us to draft them, the fee is $500 per letter. If you would rather we handle the letters from the start, the Essential package includes three.
What happens if USCIS issues a Request for Evidence?

The Basic package does not include an RFE response; we quote that separately if one is issued. The Premium package includes one RFE response.
Do I need an advanced degree or an employer?

Neither is required. NIW is a self-petition: no employer sponsor, no job offer and no PERM labor certification. An advanced degree helps but applicants also qualify on the strength of publications, citations, patents, commercial adoption or clinical and public-health impact.
How long is the engagement agreement valid?

Two years from the date you sign it. If the I-140 petition has not been filed within that period the agreement terminates; we account for the work completed and any amount paid beyond the fee earned is recorded as a credit, which may be applied to a new NIW engagement agreement signed within one year of termination.
I already paid for the $200 NIW assessment. Is it credited?

Yes. The $200 assessment fee is credited toward the attorney fee for the full application.
