Eligibility assessment and strategy (retainer $4,499 on signing)

We work through the ten regulatory criteria against your awards, original contributions, publications and citations, press coverage, judging experience and leading roles, confirm that you meet the EB-1A standard, and set the case strategy.

Evidence preparation and collection

You supply documentation of your achievements; we organize it, identify the gaps and tell you what is still missing, including award records, citation reports, patents, media coverage, review invitations and employment verification.

Recommendation letters (three included)

We help you choose your recommenders and the angle each letter should take, draft three of the letters, and review and finalize every letter in the file.

Drafting and filing ($3,000 before filing)

We draft the petition letter, your personal statement and the exhibit index, assemble the full record and file Form I-140 with USCIS.

Case tracking and approval ($2,500 after approval)

We monitor the case, report every USCIS notice promptly, and the final installment falls due once the I-140 petition is approved.

How is EB-1A different from NIW?

EB-1A is a first-preference category. It requires no employer sponsor and no labor certification, and priority dates usually move faster than EB-2, but the standard is higher: you must satisfy at least three of the ten regulatory criteria and then pass a final merits determination. NIW sits in EB-2, with a more forgiving standard but a longer queue. We will advise which fits your profile and the current visa bulletin.
How is the attorney fee paid?

In three installments: $4,499 on signing the engagement agreement, $3,000 before the I-140 petition is filed, and $2,500 after the petition is approved, for a total of $9,999.
How many recommendation letters are included?

Three letters drafted by our attorneys, plus guidance on selecting your recommenders and framing each letter, and review and finalization of every letter in the file.
Are USCIS fees included?

No. The USCIS filing fees for Form I-140 and Form I-485, the optional premium processing fee, and the $80 courier cost are billed separately. USCIS adjusts its fees periodically, so we confirm the current amounts in writing before filing.
What happens if USCIS issues a Request for Evidence?

An RFE response is not included in this package. We quote it based on the complexity of the issues raised and begin work once you approve the quote.
How many of the ten criteria do I need to meet?

At least three, but meeting three is only the threshold. USCIS then applies a final merits determination, weighing the record as a whole to decide whether you are genuinely among the small percentage at the top of your field. The weight of the evidence matters more than the count, and we will tell you which criteria carry your case.
Do I need a PhD?

No. EB-1A has no degree requirement; what matters is your achievement and influence in the field. Applicants in engineering, entrepreneurship, the arts and athletics qualify on awards, press coverage, original contributions and comparable evidence.
