Recently, the trump administration has made it harder to renew non-immigrant visas such as H1B Visa and L1 Visa, which are popular with Indian it professionals.
“This memo makes clear that the burden of proof remains with the applicant even in the event of an extension of non-immigrant status,” the USCIS said in its latest memo, released October 23, 2017.
Under the previous policy, if a person had already obtained a work visa, he could extend it.
But now, every application for a work visa extension must prove to federal authorities that they are still eligible for the visa.
“In determining eligibility, the burden of proof is always on the applicant,” USCIS said.
